The Clearing House (TCH), the Loan Syndication and Trading Association, and the American Bankers Association filed an amicus brief in support of Bank of America’s cert. petition in Bank of America v. Caulkett. The brief argues that stripping off second liens would disrupt a large sector of the commercial lending market that has justifiably relied on prior interpretation of the Bankruptcy Code.
